Man Shocked by Demand Letter To Pay Rent on His House Years after Divorce

– This mystery was unravelled when a lawyer served him a

demand letter that he needed to start paying rent

– Upon doing a search at the land registry, he learned that

his ex-wife had transferred the property to a new owner

Joel Kibunja has told the told that he was recently served by a

letter demanding him for rent on a house he calls his.

According to Kibunja, who divorced his wife of over 10 years,

the letter implied that the property had changed hands

“The letter indicated that my property had been sold and

that I should start depositing rent to an account that was

provided in the document,” Kibunja told the court, as

reported by Daily Nation .

Kibunja indicated that he at no point in his life transferred

ownership of the property to someone else.

Changes in Property Ownership

Testifying before Senior Resident Magistrate Rita Amwayi, he

added that when he went to the land registry to confirm the

property's ownership, he learned that it was no longer his.

Details indicated that his ex-wife, Ms Margaret Wathoya had

transferred the property to a woman named Sarah Wanjiru,

whom she had never met nor heard about before.

The man accused his ex-wife of forging documents to transfer

his property fraudulently.

Kibunja and Wathoya were married between 2000 and 2014, a

period within which they bought land in Mombasa and

developed it into a family home and rental houses.

He expressed that before their divorce, he took a loan and set

up a business for his wife from which they built the storeyed

building consisting of 14 units.

“The business was doing well. We used the proceeds from

the business to construct the house and also bought other

properties. It was a family business and not personal,” he

told the court.

Around 2010, their marriage started having issues and Kibuja

took charge of rent collection from the property, after which

he received a letter from a lawyer demanding that he starts

paying rent.

Wathoya Disputes Allegations

In her defence, Wathoya told the court that she legally owned

the property, adding that her ex-husband's name only

appeared in the documents because they had a child together.

According to her, the money used to develop the property was

a loan she took from Wanjiru and that Kibunja did not

contribute towards anything.

“The only thing he helped with was to supervise the

construction. I used KSh 15 million to develop the

property,” she said.

When she was unable to repay Wanjiru KSh 10 million, the

transfer was initiated to recoup the cost.
